The information below is only a short summary. The terms and conditions of the Settlement are set forth in detail in the Stipulation of Settlement (the "Stipulation"). The Stipulation, as well as additional Court documents with respect to the Action and the Settlement, is available by clicking here. Capitalized terms used at this website but not defined herein shall have the meanings assigned to them in the Stipulation.

As fully described in the Class Action Notice (the "Notice") the Class consists of:

All persons who, between February 17, 1999 and December 31, 2005, purchased within the United States an AT&T PrePaid Phone Card that had an international conversion chart and no arbitration clause, and who thereafter made at least one completed call to one of the 10 countries listed on the international conversion chart.

The below chart details the rights and options of Class members and the deadlines to exercise them:

YOU MAY SUBMIT A CLAIM FORM BY AUGUST 19, 2010. If you are a Class member, in order to share in the settlement, you must submit to the Claims Administrator a Proof of Claim form establishing that you qualify for payment and postmarked no later than August 19, 2010.
YOU MAY EXCLUDE YOURSELF BY APRIL 21, 2010. If you desire to be excluded from the Class, you must mail a written request for exclusion to the Claims Administrator, AT&T’s Counsel, and to any one of the Class Counsel, post-marked by April 21, 2010.
YOU MAY OBJECT TO THE SETTLEMENT BY APRIL 21, 2010. Any objection to the settlement, containing the information required in Section 6.H of the Stipulation of Settlement and Section 12 of the Order Certifying the Class, Preliminarily Approving Settlement and Notice of Proposed Settlement and Hearing Thereon, must be mailed or delivered such that it is received by each of the following no later than April 21, 2010: the Court, all Lead Counsel for the Class, and Counsel for the Defendants, addressed as further detailed in the Notice.
  • All members of the Class who have not requested exclusion from the Class will be bound by any judgment entered in the litigation pursuant to the Stipulation.
  • The Court still has to decide whether to approve the Settlement. Payments will be made only if the Court approves the Settlement and that approval is upheld in the event of any appeal.

GENERAL OVERVIEW

The Court has preliminarily approved a proposed Settlement (the "Settlement") of a class action lawsuit brought on behalf of all persons who, between February 17, 1999 and December 31, 2005, purchased within the United States an AT&T PrePaid Phone Card that had an international conversion chart and no arbitration clause, and who thereafter made at least one completed call to one of the 10 countries listed on the international conversion chart. The parties have agreed to the Settlement in order to settle the claims asserted in the Action. In this Action, the plaintiff alleged claims for breach of contract and violation of the New Jersey Consumer Fraud Act and contended that certain AT&T PrePaid Phone Cards contained an international conversion chart which misrepresented the number of minutes the Class Members would be charged for calls to certain foreign countries. Defendants deny any liability or wrongdoing whatsoever with respect to the allegations contained in the Complaint in the Action, and enter into the Stipulation solely to avoid the further expense, inconvenience, and burden of protracted and costly litigation.

A hearing will be held on May 28, 2010, at 1:30 p.m., before the Honorable Fred H. Kumpf, at the Somerset County Justice Complex, 20 North Bridge Street, Somerville, New Jersey, for the purpose of determining (a) whether the proposed settlement is fair, adequate and reasonable to the Class and whether the final judgment and approval should be entered by the Court; (b) whether the application of Class counsel for an award of attorneys’ fees and for reimbursement of expenses incurred in connection with this litigation should be approved; and (c) whether the application of Plaintiff as the Class Representative for an incentive award in connection with this litigation should be approved.
